While the term, “natural justice” is not mentioned in the constitution, but the essence of theory which grants the people equality of status and of opportunity have been incorporated in the Preamble of the constitution which guarantees, social, economic and political justice.
Reservation policy has been adopted initially as a means to provide natural justice to the oppressed class so that they can exercise their rights in a more systematic way. The natural justice opposes bias and gives the right of fair treatment to everyone. Hence, there was a need of reservation system to end systemic discrimination that was done against the oppressed class by the prominent class. It was a thorough attempt to uproot discrimination from the society.
But sadly, that didn’t happen. In the recent scenario, the reservation system is nothing but a bias not only against the general class, but also against those who need it the most. The living conditions differ as per the economic standards and hence, reservation should be entirely provided on the economic basis with certain riders. If the father has used reservation system to enter into a government job or a primer institution, it should not be provided to the son, since they’re already availed the help to better their living condition. It is only then, we can say that natural justice has been actually provided to the citizens.
